Who is providing this notice?This notice is provided by Atlantic Bay Mortgage Group and its family of companies, as listed in the section below titled, 'Other important information'.
What we do
How does Atlantic Bay and its family of companies protect my personal information?To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards and secured files and buildings. Our employees are committed to safeguarding customer information and preventing its unauthorized access, disclosure, or use. In accessing your personal information, our employees are bound by the Code of Ethics Policy and our information security standards.
How does Atlantic Bay and its family of companies collect my personal information?We collect your personal information, for example, when you:
  • apply for a loan or deposit money
  • open an account or pay your bills
  • provide account information
We also collect your personal information from others, such as credit bureaus, affiliates or other companies.
Why can’t I limit all sharing?Federal law gives you the right to limit only:
  • sharing for affiliates' everyday business purposes—information about your creditworthiness
  • affiliates from using your information to market to you
  • sharing for nonaffiliates to market to you

Definitions

  • Our affiliates include financial companies with an Atlantic Bay name and other financial companies such as mortgage companies, title agencies, and insurance agencies. For a list of our affiliates, see the section below.
NonaffiliatesCompanies not related by common ownership or control. They can be financial and nonfinancial companies.
  • Nonaffiliates we share with can include certain information regarding your experience with Atlantic Bay, such as, name, address, phone number, and email address. This information is shared with non-affiliates with whom we have a formal relationship to offer certain home ownership services to you. At no time will we share your social security number or loan information.
Joint MarketingA formal agreement between nonaffiliated financial companies that together market financial products or services to you:

Personal Information Does Not Include

Certain personal information we collect and process in connection with offering or providing financial products or services to consumers for personal, family, or household purposes may be exempt from the CCPA because it is subject to the Gramm-Leach-Bliley Act or other applicable laws. This Notice applies to personal information subject to the CCPA. This Notice does not include:

  • Information publicly available from resources such as government records, professional licenses, and public real estate/property records.
  • De-identified or aggregated consumer information.
  • Information excluded from the CCPA's scope, like personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

Purposes of Collection

We collect, use and share the categories of information identified above for the following purposes:

  • To provide mortgage loan origination services to you, including evaluating, processing and closing your loan application.
  • To service your loan.
  • To provide services in connection with the reason you provided the information. For example, if you provided your name and financial institution in order to make a payment in connection with the servicing of your mortgage loan, then we will use that information to process your payment.
  • To communicate with you and respond to your inquiries or requests.
  • To maintain our systems and protect against unauthorized access, security incidents, fraud and other malicious or illegal activity.
  • To market or advertise services to you.
  • To conduct research, analytics or other internal analysis to enhance our services to you.
  • Comply with legal and regulatory obligations and to establish, enforce, and otherwise exercise our rights and defend against claims.
  • To evaluate or conduct a merger, divestiture restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.

Retention of Personal Information

We retain Personal Information for as long as necessary to process and service your loan, comply with legal and recordkeeping requirements, resolve disputes, enforce our agreements, and defend claims. We retain internet or other electronic network activity information for as long as reasonably necessary for security, debugging, analytics, and legal compliance, based on the sensitivity of the data, the purpose for collection, and applicable limitation periods. Retention periods vary depending on the type of information and applicable legal requirements.

We collect personal information from:

  • You directly (e.g., forms, mortgage loan applications)
  • Automatically (e.g., cookies, tracking technologies)
  • Third parties (e.g., service providers, partners, vendors)

Disclosure of Personal Information

We may disclose your personal information to:

  • Third party service providers and contractors
  • Analytics providers and marketing partners
  • Government agencies or regulators when required by law

In the preceding 12 months, we have not sold any personal information.


Your Rights Under CCPA/CPRA

If you are a California resident, you have the following rights:

  • Right to Know and Access: You have the right to know what personal information we collect, use, disclose, or share about you. Upon verifiable request, we will provide information regarding details of the personal information we have collected, the purposes for which such information is used, and the third parties to whom it is disclosed or shared.
  • Right to Delete: You have the right to request that ABMG delete personal information that we have collected from or about you, subject to certain exceptions permitted by applicable law. ABMG may retain personal information as necessary to comply with federal and state legal obligations, to complete transactions, detect security incidents, protect against fraudulent or illegal activity, or otherwise as permitted under applicable law.
  • Right to Correct: You have the right to request that ABMG correct any personal information maintained about you that you believe is inaccurate or incomplete. In certain instances, you may update specific personal information, such as contact details or your primary address, directly through your account settings.
  • Right to Opt-Out: You have the right to request to opt out of the sale or sharing of your personal information. ABMG does not sell personal information for monetary consideration. However, we may share personal information with service providers and third parties for business purposes, including marketing and advertising.
  • Right to Limit Use of Sensitive Personal Information: Restrict how sensitive personal information is used. As defined by the CCPA “sensitive personal information” is a specific subset of personal information that includes certain government identifiers (such as social security numbers); an account log-in, financial account, debit card, or credit card number with any required security code, password, or credentials allowing access to an account; precise geolocation; contents of mail, email, and text messages; genetic data; biometric information processed to identify a consumer; information concerning a consumer’s health, sex life, or sexual orientation; or information about racial or ethnic origin, religious or philosophical beliefs, or union membership. Consumers have the right to also limit a business’s use and disclosure of their sensitive personal information.
  • Right to Non-Discrimination: Receive equal service regardless of exercising your rights.

How to Exercise Your Rights Under CCPA

Only you, or an authorized agent legally permitted to act on your behalf, may make a verifiable consumer request to exercise your rights under CCPA. We may need to verify your identity before processing your request by matching information you provide with information we maintain. Authorized agents may be required to provide proof of authorization. To request access to or the deletion of your Personal Information, or to exercise any other rights under California law, you may contact at legal@atlanticbay.com We will confirm receipt of your request to know, delete, or correct within 10 business days and respond to your verifiable consumer request within 45 calendar days of receipt. Requests to opt out of the sale or sharing of personal information, and requests to limit the use and disclosure of sensitive personal information where applicable, will be processed as soon as feasibly possible, and no later than 15 business days from the date we receive the request, subject to any delays permitted by law.
